Please contact Senators Lugar and Bayh to oppose the PASS Act.

On June 15, 2009, Sen. Daniel Akaka introduced S. 1261, the PASS Act. If passed, the PASS Act would severely compromise the safety and security of all Americans by gutting the most effective legislative response to the 9/11 Commission's recommendations: the provisions in the REAL ID law that effectively bar states from issuing driver's licenses or identification cards to illegal aliens.

The REAL ID Act was approved by the Congress following the recommendations of the 9/11 Commission's finding that "secure identification should begin in the United States," and recommended that "the federal government should set standards for the issuance of birth certificates and sources of identification, such as drivers licenses." REAL ID requires states to issue secure driver's licenses and ID cards that cannot be tampered with; it requires that applicants for these documents produce verifiable and up-to-date identification documents; and it mandates that licenses issued to foreigners in the United States temporarily expire when the individual's permission to be here expires. All but one of the 9/11 hijackers had been issued drivers licenses and state ID cards valid long past the expiration date of their visas, and some of the hijackers were unlawfully present in the United States as of the time they obtained these documents.

The state of Indiana has already done its part to comply with the REAL ID Act. The Bureau of Motor Vehicles upgraded its data base and found over 30,000 inaccuracies. As I recall, most of the problems were easily corrected. Many were the result of typographical errors or people forgetting to update their licenses when they changed their names after marrying or divorcing. Around 10,000 license errors were never corrected and many of those licenses are believed to have belonged to illegal aliens.

The 9/11 Commission recommended that the Federal government set standards for secure driver's licenses. The Congress obliged by passing REAL ID, which would have prevented some of the 9/11 terrorists from acquiring valid driver's licenses and ID cards. The PASS Act would invalidate these standards and potentially facilitate future terrorist attacks.. Please oppose Sen. Akaka's PASS Act with all of your strength!

This was recommended because the hijackers had been issued multiple state driver's licenses and ID cards. The Congress responded by passing the provisions of the REAL ID Act.

I am positive you understand the necessity of REAL ID. Individuals who are in the country illegally, whether they be visa-overstayers or people who have crossed our borders illegally, should not be issued legitimate government identification which allow them to access airports, federal buildings, or other sensitive or protected sites.

Please stand up for the safety and security of all Americans by publicly opposing the dangerous PASS Act.
