This is a special message for NumbersUSA members in Indiana who are represented by the State Senators listed below. If you are not represented by these Senators, please ignore this message.


Dear Indiana friends,


For the third year in a row, State Sen. Mike Delph (R-District 29) is promoting important legislation that would crack down on illegal immigration in Indiana. His bill (SB 580) is expected to come up for a vote in the Senate Pension and Labor Committee on February 4, so time is of the essence in contacting committee members


The proposed legislation would prohibit employers from knowingly employing illegal aliens and would require state and local governments, and their contractors, to use the federal E-Verify system to check the workplace eligibility of new hires. For private employers, the bill sets up an administrative complaint process (individuals can file complaints with the state attorney general) that could lead to a business-license suspension or revocation for those found to have knowingly hired illegal aliens. Companies that use E-Verify, however, are provided safe harbor against such administrative actions. The bill also bans sanctuary policies, requires state correctional facilities to check the immigration status of inmates, and mandates the use of the federal Systematic Alien Verification for Entitlements (SAVE) system to verify eligibility for public benefits.


In a press release, Sen. Delph said, “(a)fter discussing the bill with Senate leadership and colleagues, I am confident this will pass out of the Senate and if enacted make Indiana a leader in illegal immigration reform….We have the opportunity to come together this session saying we no longer tolerate the failure of the federal government to protect our borders and ensure our national security.”


State Sen. Dennis Kruse (R - District 14), the Chairman of the Pension and Labor Committee, will sheppard Sen. Delph’s bill (SB 580) through committee. If you are one of Sen. Kruse’s constituents, please email and call to thank him for bringing the legislation to a vote and urge him to keep the bill’s strong provisions intact. If you are a constituent of one of the other Senators on the committee, please email and call him/her to urge passage of the bill and reject efforts to undermine its provisions.

General Talking Points

It took over 20 years to create today's illegal immigration crisis, and it may take another ten to substantially reduce our current illegal population, but you can enact Sen. Delph’s “SB 580” and immediately see an increase in the number of self-deportations. This will steadily improve the quality of life and lessen the cost of government for taxpayers; make more jobs available for unemployed legal residents; and discourage future illegal immigration. And that will make Indiana a more attractive place to live and work - the kind of place that makes it worthwhile to play by the rules.


No state or country can hope to discourage illegal immigration without removing the jobs magnet that draws illegal workers to our communities. That is why it is critical for public and private employers to verify the eligibility of their employees to work in the U.S. By the same token, it is counterproductive to keep recycling illegal-alien criminals through our justice system. Those eligible for deportation should be identified in the correctional system and moved into federal custody for removal. Finally, the state can no longer afford to underwrite business' desire to hire cheap illegal labor. The cost of public benefits for illegal aliens far exceeds the taxes they pay so Indiana needs to start screening for eligibility. Pass Sen. Delph’s “SB 580.”


Our state and our nation are hurting. Please look deep inside your heart and determine whether you will stand up for policies that will free-up illegal alien jobs for unemployed Americans, reduce illegal-alien crime, and lessen the burden on taxpayers during this recession. Your constituents are counting on you -- please don't let us down! Make sure Sen. Delph’s “SB 580” clears the Pension and Labor Committee intact.



Points on E-Verify

Please support Sen. Delph’s “SB 580” which would require state and local governments to use E-Verify and create strong incentives for private employers to use it as well. There are no longer any valid excuses for allowing government or businesses to continue to hire illegal workers, not when there are so many citizens and legal residents struggling to find work.


More and more state and local governments are implementing workplace verification systems that will help all public and private employers hire a legal workforce, protect American workers from unfair labor competition, discourage illegal immigration, and end exploitative labor practices. Please help add Indiana to this list.


All Federal agencies and Congress use the E-Verify system and every federal contractor will be using it shortly. About 100,000 employers throughout the country use E-Verify, and around 1,000 new businesses sign up for the program every week. Eleven states require their government contractors to use E-Verify and many more state and local governments are passing laws to discourage illegal labor practices. Please support Sen. Delph’s “SB 580” and free up more jobs held by illegal aliens for struggling Indianans.


99.5% of legal workers with no problems in their Social Security Administration records are accurately authorized under E-Verify. Those that have inaccuracies are given instructions on how to clear up their records with SSA and time to do so. The bottom line is that those eligible to work in the U.S. will not lose their job. E-Verify protects legal workers from unfair hiring practices, protects employers from discriminatory lawsuits, and helps clean up SSA's database. Do the right thing by extending E-Verify to employers in Indiana.


The nice thing about E-Verify is nobody is automatically ruled out for work authorization. Everybody has a chance and time to prove that they are ultimately work authorized. If a person is not work authorized, it's not discrimination if you don't continue to employ them. That's complying with the law. Please support E-Verify for public and private employers in Indiana.




Points on Public Benefits

Robert Rector at the Heritage Foundation has done the most exhaustive study ever of the total taxes paid by less-educated foreign workers and of the total amount of government services they consume. He found that for fiscal year 2004, the average low skill immigrant household received $30,160 in direct benefits, means-tested benefits, education, and population-based services from all levels of government. By contrast, low-skill immigrant households paid only $10,573 in taxes. Therefore, the net fiscal burden for all levels of government for each household is $19,588 per year. At the state and local level, the average low skill immigrant household received $14,145 in benefits and services and paid only $5,309 in taxes, so the net fiscal burden is $8,836 per year for each household. With public coffers hurting during this recession, it is more important than ever to pass Sen. Delph’s “SB 580” so that we can ensure taxpayer dollars are spent only on citizens.


Most foreign workers in this country are an incredible drain on taxpayers, especially on those who pay property and sales taxes to state and local governments. The Heritage Foundation discovered that the typical household headed by a low-educated foreign worker uses $20,000 more in public services than paid in taxes -- with most of the net cost on state and local governments. Our state and our nation are hurting. Please enact Sen. Delph’s “SB 580” which will prevent taxpayers from having to foot the bill for illegal-alien public benefits.


Points on Status Checks in Prisons

It is dangerous, expensive and counterproductive to keep recycling illegal-alien criminals through our justice system. Those eligible for deportation should be identified in the correctional system and moved into federal custody for removal. Indiana needs the additional protection afforded by the prison immigration status check contained in Sen. Delph’s “SB 580.” I'm counting on you to make this happen.


Indiana is not doing enough to prevent the release of criminal aliens into our communities after they finish their sentences. How many crimes have been committed, and lives lost, because the state is not checking the immigration status of inmates. The Department of Homeland Security deported almost 100,000 criminal aliens from prisons in 2007, the latest year for which data are available. They were imprisoned for serious felonies, including dangerous drugs, burglary, assault, sexual assault, robbery. We need to adopt Sen. Delph’s “SB 580” and send criminal aliens in Indiana prisons back home now!
