Please vote and help this new group in Elgin, IL educate people about illegal immigration. The newspaper is printing stories for 7 days in a row, so be sure to check back and vote. I wish our newspapers in NW Indiana would do this!

This group is actively pursuing action to reduce the illegal alien component in their local population by attempting to educate the public at large with the assistance of the local media.

ELGIN -- In response to the failure of Congress to pass a comprehensive illegal immigration reform policy, a number of municipalities throughout the country have taken measures toward passing ordinances that address the issue on a local level.

Most have centered on the economic side of the issue, with tougher enforcement on businesses that employ or landlords who house illegal immigrants.

City officials address Social Security number verification and the federal E-Verify system, restricted by the Illinois General Assembly. Elginites David White and Douglas Heaton are leaders of a group known as the Association for Legal Americans, or AFLA, which has asked the Elgin City Council to consider seven local initiatives to address the issue of illegal immigration in Elgin. Heaton and White say they have about 2,000 local members who believe that in the absence of any meaningful effort by the federal and state governments, some directives can be enacted at a local level. The Courier News has asked all seven Elgin City Council members to respond in writing to each question. Through Thursday, Dec. 13, we will publish the AFLA requests and the responses by the council members, edited only for style. Courier News readers can weigh in on each day's issue by going online to www.couriernewsonline.com. Click on "ILLEGAL IMMIGRATION," where that day's issue and responses will be posted, as well as a "CAST YOUR VOTE" box where readers can agree or disagree. The poll is limited to one vote per computer per day. Voting can occur from 4 a.m. on the day the question appears until midnight. Final results will appear in The Courier News and on www.couriernewsonline.com on Sunday, Dec. 16.

In Elgin, like most other municipalities, it is against policy to do business with anyone engaged in illegal activity, such as employing illegal immigrants.

According to Gail Cohen, city purchasing director, enforcement of a possible violation is based on receipt of a complaint, which would lead to an investigation of its validity.

Penalties for employers found in violation could range from firing just the worker in question to terminating the contract with the employer and banning them from receiving any future contracts with the city for up to three years.

But Cohen pointed out that since an illegal work status complaint has never been filed with the city regarding any of its contractors, talk of enforcement for now is just theoretical.

"We haven't had any complaints," she said. "We have not had anything brought to our attention regarding a contractor who was employing illegal aliens or people that weren't legally able to work."

Cohen said complaints should come in the form of a letter addressed to the Purchasing Director, at the City of Elgin, 150 Dexter Court, Elgin, IL 60120.

Following are responses provided to The Courier News by the city council that address the request by the local Association for Legal Americans that the city should not do business with anyone who hires illegal immigrants. The answers are presented in their entirety, and have been edited only for style.

"It is a city policy not to do business with anyone who hires illegal aliens. There is a city contractual provision that requires any contractor to comply with all applicable, federal, state and other requirements of law including, but not limited to, among other specified matters legal status of employees. However, there is litigation between the federal government and the state of Illinois regarding the federal employee verification program known as E-Verify. The city is awaiting on the outcome of such litigation."

"The city's existing policy is to not do business with anyone who hires illegal aliens. For approximately the past one year the city has included in its contracts with companies doing business with the city a contractual provision requiring such companies to comply with laws which require that their employees have legal status."

"I support the city's policy to not do business with anyone who hires illegal aliens. The city requires that all businesses that have contracts with Elgin must comply with state and federal statutes in regard to the hiring of illegal aliens. Noncompliance with these laws is a breach of contract and can lead to termination of the agreement between the city and the business in question. Pending the litigation regarding the federal E-Verify database, the city may supplement its contracts with provisions requiring that businesses seeking contracts with Elgin use the E-Verify system. That is yet to be determined."

For the past year or so we have added a clause to all contracts made with providers that the providers have to conform not only to this city ordinance but also any state and federal laws requiring their employees have legal status. The penalties for a violation provide up to a termination of the contract with the provider."
